The deadly dam burst of an iron ore mine in Brumadinho, Brazil, the catastrophic fire at the Ali Entreprise textile factory in Pakistan and many other cases of human rights violations in global supply chains have testified legal gaps in protection and practical hurdles in access to justice prevent survivors and other affected persons from successfully claiming damages. This is especially true in transnational case constellations. Legislative processes at national and EU level as well as the negotiation process for a UN treaty on business and human rights should change this. The panellists will analyse the obstacles that victims of human rights violations and environmental damage face in concrete case studies when suing for their rights. They will discuss the potential and limitations of national legislative initiatives in Germany and Brazil, as well as the requirements for a future EU supply chain law and a UN agreement, so that human rights violations are prevented and those affected have access to justice.
