Civil society proposal for the Conclusions and Recommendations of the Report of the 4th session of the OEIGWG

Civil society members of the Treaty Alliance, The Global Campaign to Reclaim Peoples Sovereignty, Dismantle Corporate Power and Stop Impunity, and Trade Unions proposal for the Conclusions and Recommendations of the Report of the 4th session of the OEIGWG

This week, we have witnessed a landmark moment in the UN Human Rights Council. States have begun negotiating the text of the UN treaty on transnational corporations and other business enterprises with respect to human rights.

This represents important progress for the countless communities, workers, and survivors who have struggled for decades to protect their human rights from violations and abuses by transnational corporations and other business enterprises.

On Friday the 19th of October 2018, the OEIGWG will adopt its report of this session, with recommendations and conclusions for moving the process forward. As civil society organisations, we look forward to the report, and recommend the following elements be included:

-An explicit commitment to continue with the 5th OEIGWG session, and as many subsequent sessions of the OEIGWG as are needed to elaborate an ambitious legally binding instrument;
-Informal intersessional consultations, guaranteeing meaningful civil society participation;
-National consultations, guaranteeing civil society participation;
-Publication of a strengthened Draft One based on inputs and comments made on the Zero Draft and during the previous sessions, including the critical inputs made by civil society and affected communities throughout the process;
-A reasonable timeline for additional written submissions by states and civil society on the zero draft.

Last year at the end of the 3rd session, valuable time and energy was wasted by attempts to hold up the process. We call on all States to support the conclusions of the 4th session in view of advancing the negotiations until a bold and ambitious legally binding instrument is adopted.

Propuesta de la sociedad civil para las conclusiones y recomendaciones del informe de la 4ª sesión del OEIGWG

Esta semana, hemos sido testigos de un momento importante en el Consejo de Derechos Humanos de la ONU. Los estados han comenzado a negociar el texto del tratado de la ONU sobre empresas transnacionales y otras empresas con respecto a los derechos humanos.

Esto representa un progreso considerable para las innumerables comunidades, trabajadores, trabajadoras y sobrevivientes que han luchado durante décadas para proteger sus derechos humanos de las violaciones y abusos cometidos por empresas transnacionales y otras empresas.

El viernes 19 de octubre de 2018, el OEIGWG adoptará su informe de esta sesión, con recomendaciones y conclusiones para hacer avanzar el proceso. Como organizaciones de la sociedad civil, esperamos con interés el informe y recomendamos que se incluyan los siguientes elementos:

-Un compromiso explícito de continuar con la quinta sesión del OEIGWG y tantas sesiones subsiguientes del grupo de trabajo, según sea necesario, para desarrollar un instrumento ambicioso legalmente vinculante;

-Consultas informales en el período entre sesiones, garantizando en particular la participación de la sociedad civil;
-Consultas nacionales, particularmente garantizando la participación de la sociedad civil;
-La publicación de un Borrador Uno que se fortalezca sobre la base de los aportes y comentarios realizados en el Borrador Cero y durante las sesiones anteriores, incluidos los aportes críticos realizados por la sociedad civil y las comunidades afectadas durante todo el proceso;
-Un período razonable para presentaciones escritas adicionales de los Estados y la sociedad civil en el Borrador Cero.

El año pasado, se desperdició tiempo y energía valiosos al intentar detener el proceso al final de la 3ª sesión. Hacemos un llamado a todos los Estados para que apoyen las conclusiones de la 4ta sesión con el fin de avanzar en las negociaciones hasta que se adopte un audaz y ambicioso instrumento legalmente obligatorio.
